Beacon Hosting – Terms of Service

1. Eligibility

You must:

• Be at least 13 years old to access our services.
• If under 18, possess explicit consent from a parent or legal guardian.
• Have legal capacity to enter binding contracts.
• Not be restricted from using services under Australian law.
• Not have previously been suspended or banned by Beacon Hosting.
• Maintain a valid form of contact and accurate information at all times.

2. Account and Security

You agree to:

• Maintain confidentiality of your account credentials.
• Accept responsibility for all activities under your account.
• Report security breaches and vulnerabilities to Beacon Hosting immediately.
• Not circumvent or compromise our security measures.

3. Acceptable Use and Abuse

You must not:

• Engage in illegal activities or violate applicable laws.
• Conduct denial-of-service (DoS) or distributed denial-of-service (DDoS) attacks.
• Attempt unauthorized access to any systems or data.
• Host or distribute pirated, illegal, or malicious content.
• Use excessive resources negatively impacting other users unless explicitly permitted by your hosting plan.

4. Support

Beacon Hosting services are unmanaged unless specifically stated. Technical support is provided via support tickets. Abusive conduct towards our staff may result in immediate service suspension without refund.

5. Modifications and Interruptions

Beacon Hosting may:

• Update, modify, or terminate services at its discretion.
• Revise these Terms periodically, notifying users via our website. Continued use constitutes acceptance.

6. Refund Policy

• Refunds are provided at Beacon Hosting's discretion within 24 hours of purchase, except for dedicated servers, VPS, and addons, unless defective or as required by Australian Consumer Law.
• Refunds requested due to abuse of policy will be denied.

7. Data and Backups

• Beacon Hosting will endeavor to protect and preserve data but is not liable for loss unless required by Australian Consumer Law.
• Automatic backup software negatively impacting resources is prohibited.

8. Indemnification and Liability

• You agree to indemnify Beacon Hosting, its employees, directors, agents, and affiliates against all liabilities, claims, damages, and expenses resulting from your misuse or violation of these Terms.
• Beacon Hosting excludes liability for indirect, incidental, consequential, or punitive damages to the maximum extent allowed under Australian law. This does not limit statutory rights under Australian Consumer Law.

9. Dedicated Servers and VPS Specific Terms

Prohibited uses include:

• Hosting illegal or pirated material.
• Sending unsolicited or spam emails.
• Port scanning, phishing, or unauthorized penetration testing.
• Running TOR nodes or cryptocurrency mining.
• Excessive or unauthorized resource-intensive activities (e.g., AI training, machine learning) without express permission.

10. MySQL and Database Services

• Database use must relate directly to your hosted services.
• Databases exceeding fair-use limits (default 20GB soft limit) may incur additional fees or suspension until resolved.
• Beacon Hosting is not liable for database loss or corruption except as required by Australian Consumer Law.

11. Account Credit

Beacon Hosting account credits are non-refundable, non-transferable, and can only be used for Beacon Hosting services.

12. Governing Law and Jurisdiction

• These Terms are governed exclusively by the laws of Western Australia.
• You consent to the exclusive jurisdiction of the courts located in Western Australia for dispute resolution.

13. Severability

If any clause or term is determined unenforceable by a Western Australian court, that clause will be severed without affecting remaining Terms.

14. Entire Agreement

These Terms and our Privacy Policy constitute the complete agreement between you and Beacon Hosting concerning service usage, superseding all prior agreements and communications.
