These Terms of Service ("Terms") constitute a legally binding agreement between Beacon Hosting Pty Ltd ("Beacon Hosting," "Company," "we," "us," or "our") and you ("User," "Customer"). Beacon Hosting may suspend or terminate Services where reasonably necessary to address abuse, security threats, unlawful activity, material breaches of these Terms, or risks to Beacon Hosting, its infrastructure, personnel, or other customers.
Where immediate action is reasonably necessary, Beacon Hosting may suspend or restrict a Service without prior notice.
Where a Service Level Agreement ("SLA") applies to a particular Service, the support and service commitments contained in that SLA will apply in addition to these Terms.
Beacon Hosting may:
Beacon Hosting will make reasonable efforts to provide advance notice of planned material service discontinuations where practicable.
Beacon Hosting does not guarantee uninterrupted or error-free operation of the Services except to the extent expressly provided in an applicable SLA or required by law.
Beacon Hosting may update these Terms from time to time.
Updated Terms will be published on the Beacon Hosting website and will include a revised effective date.
For material changes, Beacon Hosting may provide notice through email, the customer account, the Beacon Hosting control panel, or another reasonable communication method.
Where Beacon Hosting requires affirmative acceptance of updated Terms, you may be required to review and accept the updated Terms before continuing to use affected Services.
Unless otherwise stated in the notice, updated Terms will become effective on the stated effective date. To the extent permitted by applicable law, continued use of the Services after the effective date constitutes acceptance of the updated Terms.
You agree to pay all applicable fees for the Services you purchase.
Prices, billing intervals, included resources, and other applicable charges will be presented at the time of purchase or otherwise made available to you.
Beacon Hosting may change prices for future billing periods by providing reasonable notice where required by applicable law or the applicable service terms.
Where a Service is purchased on a recurring basis:
If a payment fails or remains unpaid, Beacon Hosting may:
Where reasonably practicable, Beacon Hosting will provide notice before suspending or terminating a Service for non-payment.
You may cancel a Service through the cancellation mechanisms provided by Beacon Hosting.
When cancelling a Service, you may choose, where supported by the applicable Service:
Unless otherwise expressly stated by Beacon Hosting or required by applicable law, choosing immediate cancellation does not entitle you to a refund, partial refund, account credit, or other compensation for the unused portion of the paid billing period.
Payments are generally non-refundable except where a refund, replacement, cancellation right, or other remedy is required under applicable law or is expressly provided by Beacon Hosting.
A change of mind, accidental purchase, incorrect purchase, lack of technical knowledge, dissatisfaction with a Service, or failure to cancel a recurring Service before its renewal will not ordinarily qualify for a discretionary refund.
Nothing in these Terms excludes, restricts, or modifies any rights or remedies that cannot lawfully be excluded, restricted, or modified, including rights under the Australian Consumer Law.

Where reasonably practicable, Beacon Hosting will provide notice before suspension. Immediate suspension may occur where delay could reasonably cause harm, security risk, abuse, or other material consequences.

Where reasonably practicable, Beacon Hosting may provide an opportunity to remedy a breach before termination.
Upon termination or cancellation:
Termination does not affect rights or obligations that by their nature are intended to survive termination.
You are responsible for maintaining appropriate backups of data stored through the Services.
Beacon Hosting may provide backups, snapshots, or other data-protection features for selected Services. Unless expressly stated otherwise, these features should not be treated as a guarantee that your data can always be recovered.
Beacon Hosting is not responsible for loss, corruption, deletion, or inability to recover Customer data except to the extent required by applicable law or expressly provided under an applicable SLA or service agreement.
You acknowledge that:
For trial Services, Beacon Hosting may restrict or disable backup downloads, file downloads, SFTP downloads, data exports, or other data-retrieval functionality.
You retain ownership of data, files, content, and other materials that you lawfully upload or store through the Services ("Customer Content").
You grant Beacon Hosting a limited, non-exclusive, worldwide licence to host, store, transmit, reproduce, process, and otherwise handle Customer Content only to the extent reasonably necessary to:
You are responsible for ensuring that you have all rights, permissions, and licences necessary for Customer Content to be stored and processed through the Services.
Beacon Hosting does not claim ownership of Customer Content.
Beacon Hosting may remove, restrict access to, or preserve Customer Content where reasonably necessary to comply with law, enforce these Terms, address abuse or security issues, or protect Beacon Hosting or others.
Services may be subject to resource limits, fair-use requirements, technical restrictions, or product-specific specifications.
You must not use a Service in a manner that materially degrades the performance, availability, security, or reliability of the Services for other customers.
Depending on the applicable Service, this may include sustained or abnormal use of:
Beacon Hosting may take reasonable measures to protect infrastructure and other customers from excessive or harmful resource usage, including throttling, restricting, suspending, or requiring migration to a more appropriate Service.
Any product-specific resource limits published by Beacon Hosting form part of the applicable Service terms.
Dedicated Servers and VPS products may be subject to additional restrictions due to their network, hardware, or infrastructure characteristics.
Unless expressly approved by Beacon Hosting in writing, the following activities are prohibited:
Beacon Hosting may impose additional restrictions where reasonably necessary to protect its network, infrastructure, upstream providers, or other customers.
Where database Services are provided:
Beacon Hosting may, at its discretion, offer free or discounted trial Services for selected products.
Trial Services are provided for evaluation purposes and may include functional limitations, resource restrictions, or disabled features.
During a trial, users may be restricted from:
Beacon Hosting may modify trial functionality or restrictions during the trial period.
To obtain full functionality, including file downloads, backup downloads, or data export capabilities, you may be required to convert the trial into a paid subscription and maintain a valid payment method.
Data created, uploaded, or stored during a trial may not be recoverable after the trial ends. You are responsible for maintaining independent copies of any data you wish to retain.
Beacon Hosting may suspend or terminate a trial where reasonably necessary, including for abuse, security, capacity, operational, or commercial reasons.
Activation of a paid subscription following a trial does not create a refund right for the trial or the resulting paid subscription except where required by applicable law.
Beacon Hosting and its licensors retain all rights, title, and interest in:
Subject to these Terms, Beacon Hosting grants you a limited, non-exclusive, non-transferable, revocable right to use the Services for their intended purpose.
You must not, except where expressly permitted by law:
Nothing in this section transfers ownership of Customer Content to Beacon Hosting.
Beacon Hosting may use third-party providers to provide or support the Services, including providers of:
Third-party services may be subject to separate terms and conditions.
Beacon Hosting remains responsible for its obligations under these Terms to the extent required by applicable law, but is not responsible for independent third-party services outside Beacon Hosting's reasonable control.
Where an applicable Service Level Agreement ("SLA") applies to a Service, the SLA forms part of the agreement between Beacon Hosting and the Customer for that Service.
The SLA may provide specific availability commitments, exclusions, service credits, or other remedies.
Where these Terms and an applicable SLA conflict, the SLA will govern only to the extent of the conflict concerning the specific service-level commitment.

Where a document applies to a particular Service, you agree to comply with it.
If there is a conflict between these Terms and a document expressly applicable to a particular Service, the more specific Service terms will govern to the extent of the conflict, unless otherwise stated.
The Privacy Policy governs Beacon Hosting's handling of personal information and should be read alongside these Terms.
To the maximum extent permitted by law, you agree to indemnify Beacon Hosting and its directors, officers, employees, contractors, and affiliates against losses, claims, liabilities, damages, and reasonable expenses arising directly from:
This indemnity does not apply to the extent that a claim or loss was caused by Beacon Hosting's own unlawful conduct, negligence, or other conduct for which liability cannot legally be excluded.
To the maximum extent permitted by applicable law:
Nothing in these Terms excludes, restricts, or modifies any liability, guarantee, warranty, right, or remedy that cannot lawfully be excluded, restricted, or modified, including rights under the Australian Consumer Law.
Where applicable law permits liability to be limited or excluded, these limitations apply only to that extent.
Beacon Hosting will not be responsible for delay, interruption, or failure to perform its obligations to the extent caused by circumstances beyond its reasonable control.

Beacon Hosting will take reasonable steps to mitigate the effects of such events where practicable.
You agree that Beacon Hosting may communicate with you regarding your account and Services through:
You are responsible for maintaining a current and accessible email address on your account.
Notices concerning material changes to these Terms, significant service changes, security matters, or account actions may be provided through one or more of these communication methods.
Beacon Hosting's collection, use, storage, disclosure, and handling of personal information is governed by the Privacy Policy.
Where applicable, Beacon Hosting may also enter into a Data Processing Agreement ("DPA") with customers requiring additional data-processing terms.
The Privacy Policy and DPA do not replace these Terms and apply according to their respective purposes.
Following cancellation or termination, Beacon Hosting may retain Service data for a limited period to allow for operational processing, dispute resolution, fraud prevention, legal compliance, or other legitimate purposes.
After the applicable retention period, Beacon Hosting may permanently delete the Service and associated data.
The applicable retention period may vary between Services and may be stated in product documentation, the applicable SLA, or another Service-specific agreement.
You are responsible for downloading or otherwise retaining any data you wish to keep before the applicable deletion deadline.
You may not transfer or assign your account or rights under these Terms to another person without Beacon Hosting's prior written approval, except where such restriction is prohibited by law.
Beacon Hosting may assign or transfer these Terms or its rights and obligations in connection with a merger, acquisition, corporate restructuring, sale of assets, or transfer of the relevant business or Service.
A failure or delay by Beacon Hosting to enforce any provision of these Terms does not constitute a waiver of its right to enforce that provision in the future.
A waiver is effective only if expressly given by Beacon Hosting.
If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision will be interpreted or modified to the minimum extent necessary to make it enforceable where legally possible.
If it cannot be made enforceable, it will be severed to the extent necessary without affecting the validity or enforceability of the remaining provisions.
These Terms, together with any applicable Acceptable Use Policy, Service Level Agreement, Data Processing Agreement, product-specific terms, order details, and other documents expressly incorporated by reference, constitute the agreement between you and Beacon Hosting concerning the applicable Services.
The Privacy Policy governs the handling of personal information and applies alongside these Terms.
These Terms supersede prior versions of the Terms concerning the same Services, subject to any rights or obligations that accrued before the effective date of the updated Terms.
These Terms are governed by the laws of Western Australia, Australia.
Subject to any mandatory rights or jurisdictional requirements under applicable law, you submit to the jurisdiction of the courts of Western Australia.
